Mount Pleasant divorce attorney, Emily G. Johnston, provides comprehensive representation in all matters related to divorce. We assist clients with all aspects of the divorce process, including:
- Contested divorce. In South Carolina, the grounds for divorce include adultery, alcoholism and/or drug addiction, physical abuse, living apart for one year, or desertion. Contact divorce lawyer Emily Johnston if you plan to file for divorce--either a contested or uncontested divorce.
- Child Custody. South Carolina awards both physical and legal custody. Legal custody can be either sole legal custody or joint legal custody. Physical custody is either sole, where the child lives with one parent, or joint, where the child lives with both parents for a pre-set period of time each week or month. We will help you determine which arrangement is best for you and your children.
- Visitation or Parenting time. The non-custodial parent is usually granted court-ordered visitation rights. If parents cannot agree on a visitation schedule, the family court judge will determine a plan for them. Emily Johnston can help you work through visitation disputes so that you determine your parenting time which will then be confirmed by the family court.
- Child Support. There are state child support guidelines based on the income of both parents. The basic child support award can be modified by the family court judge depending on other factors such as educational expenses, the outcome of the equitable distribution of property, extraordinary medical expenses, other support obligations, amount of alimony paid, or personal agreement between the parents. We will help you develop an accurate estimate of child support using the state guidelines and other factors in your case.
- Prenuptial Agreements. Our law firm drafts prenuptial agreements, uses them during divorce proceedings to achieve a settlement, and may file an action seeking enforcement of the pre-nuptial agreement.
- Enforcement and Modification. Emily Johnston institutes enforcement actions to collect child support payments, equitable distribution awards, and alimony payments. Our law firm also files complaints for modification of orders when one of the party’s circumstances (such as a job, residency, marital status, or health) changes.
- Settlement Agreements. Ms. Johnston is skilled at drafting agreements relating to all aspects of divorce, including settlement agreements, pre-marital agreements, post-marital agreements, global agreements, and property division settlement agreements.
